Drones Stretch the Legal Boundaries in the Sky

FORT MYERS, FL - Drones are the talk among hobbyists and a hot commodity at Paradise Hobbies in Fort Myers.

"These things are everywhere... really," said Chris Velez who works at one of the hobby stores. "And a lot of people see things in the night sky and think, oh my God it's a UFO or whatever."

Velez says for about a hundred bucks you could own one too. Ads are popping up on radio.

"Imagine seeing your neighborhood from a whole new perspective several hundred feet up. You may call them drones but paradise hobby simply calls them fun," (radio ad).

Many are worried about privacy with all of these drones airborne.

"We recommend people don't use it for the wrong reasons, but of course you never know who's who. People are going to use it for dumb reasons," said Velez.

As for the legality, there are laws regarding what is above.

"If you had somebody who was flying a drone in your airspace that you own, then that would be illegal as a trespass," said attorney Benjamin Russell.

Attorney Russell tells us in sparsely populated areas like Florida, you own up to 500 feet of airspace over your backyard. Even if you spot a drone and file a claim, it may be difficult.

"You have to find out who owns this drone, whose operating this drone, and that may be a difficult thing if you can't see them," said Russell.

For now it's a bit of a gray area -- but the FAA is working on stricter rules and regulations.
